New Delhi: The Supreme Court on Monday dismissed two petitions challenging the Agneepath scheme saying the scheme is not arbitrary. Advocates Gopal Krishna and ML Sharma filed the petition.

The court made an important remark that before the launch of the Agneepath scheme, the candidates selected in the defence recruitment process do not have the inherent right of appointment. In February, the Delhi High Court dismissed the petitions, upholding the validity of the Agneepath scheme.

Two petitions were filed in the apex court challenging the Delhi High Court’s decision. The High Court had stated in its order that the Agneepath scheme was prepared in the national interest.

The Supreme Court listed another petition related to the recruitment process in the Indian Air Force before the launch of the Agneepath scheme for hearing on 17 April. The bench asked the union government to file its reply on the third petition related to recruitment in the Indian Air Force.

The Centre rolled out the new Army Recruitment Policy called Agnipath on June 14 last year which youth of 17.5 to 21 years can apply. The scheme has been designed to enable a youthful profile of the Armed Forces, said the Centre.
